The Community

Located 30 minutes from the Las Vegas airport, Boulder City is a delightful and unique desert town located in the southern
tip of Nevada. Boulder City enjoys a distinctive heritage, with its roots beginning with the implementation of one of the most significant public works projects of our time -- the Boulder Canyon Project, a monumental federal undertaking resulting in the construction of Hoover Dam.

Today, Boulder City prides itself in its commitment to support solar energy development. It is the home to one of the largest commercial scale photovoltaic solar energy plants in the United States and is working toward making its mark as a leader in solar energy generation in the world. It is the home to two solar energy plants, Sempra Energy’s Boulder City Solar and Acciona’s Nevada Solar One. An additional 6,000 acres are currently under lease for future solar energy development in partnership with world energy development leaders. Our active solar and gas leases cover 4,745 acres and generate 1,165 megawatts of power.

Nearly all of the land within the Boulder City limits is owned by the City, and this land is an important asset to the community. The City has a controlled growth ordinance, which limits residential and hotel-motel development and has many restrictions regarding how land can be disposed of or sold.

This land asset has also made it possible for the City to develop many large parks, a multi-species conservation preserve and world renowned mountain biking trails. Boulder City isn’t a sleepy, little town—it is a vibrant, tourist-based community, that hosts many special events and supports many recreational activities.

The City is the home to three golf courses—two of which are municipal golf courses. Boulder City Golf Course or “Muni” as it is fondly called is an 18-hole golf course developed in the ‘70’s. Boulder Creek Golf Course is a 27-hole desert golf course developed in the early ‘00’s.

The population of Boulder City is currently estimated to be 16,000. Following a period of extremely rapid growth, in 1979 the City adopted a controlled growth ordinance for the purpose of controlling the rate and distribution of development throughout the community to ensure the adequacy of the City’s facilities and services within acceptable allocation of City revenues. The controlled growth requirements and philosophy are zealously monitored by City residents. Approximately 25% of Boulder City’s population represents senior citizens and retirees from government and corporate pursuits. Geographically, Boulder City is the largest city in Nevada—over 200 square miles in size, so it had plenty of opportunity to grow along with the Las Vegas Valley. But, Boulder City has chosen to remain a small town and true to its historic beginnings.

Boulder City residents enjoy and are vigilant in protecting a high quality of life and in preserving the excellent family-oriented and small town nature of the community; gaming is prohibited by City charter, resulting in a community atmosphere unlike any municipality in Nevada.

Yet, Boulder City is a community that has that home town feel. It is a close knit community that has a strong volunteer base. Boulder City residents are friendly and cordial, involved in their community and vocal in their opinions. They will tell you when they think you’ve done a good job and won’t hesitate to point out mistakes as well. Boulder City schools are a part of the Clark County School District. Boulder City parents are very involved in their children’s education, and it is this commitment that has assisted Boulder City High School becoming the recipient of the prestigious “5-star rating“ designation, of which only a handful of schools in Clark County have received. The five stars are only given to The highest performing schools in the school district’s ranking system of the School Performance Framework for the high schools models of excellence.

Boulder City’s Legal Environment

The City of Boulder City’s City Attorney services are provided by the employees of the City Attorney’s Office and supplemented by contracted legal services for specialized area of law. The City also has the legal services of the Nevada Public Agency Insurance Pool (POOL) and the Public Agency Compensation Trust (PACT), otherwise known as POOL/PACT for pre-defense and litigation representation related to any legal matter covered by the City’s insurance coverage. Legal services are primarily used to support the day-to-day activities involving the City is generally related to land use matters and occasionally employment law. Land use cases may include disputes over City decisions regarding implementation of the Master Plan, Zoning Code or the State Environmental Policy Act. In most cases, the City is represented by POOL/PACT.

Prosecution services are provided through an outside contract with contract administration and oversight provided by the City Attorney. Public Defense services are also provided through a contract, but is administered by the Municipal Court.

The City Attorney
The current City Attorney has been with the City seventeen years. He has announced his retirement date as July 1, 2017.

The City Attorney Position

This is a hands-on position reporting directly to the City Council. The City Attorney works with the City Manager, City Clerk and contract attorneys. Although Boulder City is a small town, there is a lot happening, so the ideal candidate must be highly motivated and a hard worker with a can do attitude. The individual must be an excellent communicator. He/she must be a person who can see the “big picture”, but also understand how the individual steps or components that make up that “big picture”.

The City Attorney must keep all of the City Council members abreast of issues and well informed—this is a small town and elected officials do not want to hear of issues or problems on the street—they want to hear of them from their attorney. The ideal candidate will provide the elected officials with unfiltered information and provide both the pros and cons of various
issues.

Personal Traits/Management Style

The ideal candidate should be a problem solver, practical and a person who genuinely cares about Boulder City and its residents. The individual must be savvy to the needs of large corporations who are doing solar development in Boulder City. Although Boulder City is essentially a landlord for these solar sites, it considers itself a “partner” in the development of these solar leases and facilities. Because Boulder City is very close to a large metropolitan area, the individual must understand the importance of working with other governments and regional boards and be extremely competent in that arena.

Candidates should have a thorough knowledge of ordinances, statues, and court decisions related to municipal entities, particularly in the areas of community development, public works, public safety, and finance: organization, powers, and limitations of governmental functions and officials with particular emphasis on municipalities; philosophies, techniques, and principles of municipal law and legal system; and the rules of order governing the conduct of public meetings. Candidates with the ability to communicate effectively, both orally and in writing; establish and maintain effective working relationships with those contacted in the course of work; exercise initiative, creativity, and sound judgment in solving difficult administrative, technical, and personnel problems; and provide recommended courses of action when analyzing legal problems, issues, questions, and other situations requiring legal interpretation will be valued.

Required Qualifications

The City Attorney shall be an attorney at law, admitted to practice before the Supreme Court of the State of Nevada, who has been in actual practice in the State of Nevada for at least 3 years next preceding his or her appointment.

If practicable, the Council shall appoint an attorney who has had special training or experience in municipal corporation law.

Representative Duties of the City Attorney include:

Performs legal research for the Mayor, City Council and city officers
Provides legal advice to the Mayor, City Council and city officers
Prosecutes violations of city ordinances and state misdemeanors in Municipal Court
Drafts or reviews all contracts and other legal documents or instruments
required or requested by the City Council or City Manager
Drafts ordinances
Prepares for and attends all meetings of the City Council
Responds to all civil lawsuits filed against the city or its officers and/or employees

Residency
Residency in the community is required.

Special Requirements, Licenses and Certificates
Licenses: Valid State of Nevada Motor Vehicles operator’s License at time of appointment.

Compensation
The City Attorney’s starting salary is based on experience and qualifications. The City also offers an attractive benefits package including:

Dental Insurance – Provided through Teamsters Trust and is currently 100% employer paid. Diversified Dental (PPO)

Vision Insurance - Provided through Teamsters Trust and is currently 100% employer paid. Vision Service Plan (PPO)

Life Insurance – Provided through Standard Insurance Company and is currently 100% employer paid. Life and AD&D

Retirement – Provided through the Nevada Public Employees’ Retirement System (PERS). The City of Boulder City provides an Employer Pay Contribution Plan (EPC). Under this pre-tax plan, the employer pays the total PERS contribution on your behalf. You pay for your half of the PERS contribution through a salary reduction or in lieu of a pay raise.

Holidays – Elven and a half holidays and an additional floating holiday per calendar year.

Leave Benefits – After one year of eligible employment you will have 120 hours annual leave available with increasing accrual rates based on tenure milestones. Sick leave accrues at 10 hours per month and other leaves are available.

Relocation Costs – Reimbursement up to $5,000 for relocation expenses.
